"Interim Measures for Returning Goods on the Internet for 7 Days No Reason" 3.15

On January 6, 2017, the State Administration for Industry and Commerce issued Order No. 90 to promulgate the “Interim Measures for the Return of Goods on the Internet for 7 Days without Reason”. This interim measure came into effect on March 15, 2017.

First, the scope of application


Consumers need to purchase goods through the Internet for the purpose of daily consumption. These Measures shall apply to returns within 25 days of receipt of the goods in accordance with Article 25 of the Consumer Protection Law.
Operators use television, telephone, mail order, etc. to sell goods, in accordance with these Measures.


Second, what products do not apply no reason to return


The following goods do not apply for seven days no reason to return the provisions:
(a) consumer-made products;
(b) Fresh and perishable commodities;
(3) digital products such as audio-visual products and computer software downloaded online or opened by consumers;
(d) Delivery of newspapers and periodicals.


Goods that are of the following nature are confirmed by the consumer at the time of purchase and may not apply for seven days without a reason to return the goods:
(1) Commodities that are likely to affect personal safety or life and health after being unpacked, or commodities that are likely to cause changes in the product quality after unpacking;
(2) Products that have been devalued as a result of activation or trial;
(3) Goods that are close to the expiration date and have defective goods that have been expressly sold.


The seller of online commodities shall adopt technical measures or other measures to explicitly mark the commodities that are not applicable for return within seven days as stipulated in Article 6 of these Measures.
In accordance with the provisions of Article 7 of the present Measures, sellers of online commodities shall set up significant confirmation procedures in the procedures for the sale of commodities for the consumer to confirm the single purchase. If there is no confirmation, the seller of online goods must not refuse to return the goods within seven days.

Consumers open a package of goods based on inspection needs, or perform reasonable debugging to confirm the quality and function of a product does not affect the integrity of the product.


If the use of commodities exceeds the requirements for checking and confirming the quality and functions of the commodities, and the value of the commodities is greatly derogated, the goods are considered to be incomplete. The specific criteria are as follows:
(1) Food (including health foods), cosmetics, medical equipment, and family planning supplies: necessary disposable sealed packaging is damaged;
(2) Electronics and electrical appliances: Unauthorized maintenance, modification, destruction, alteration of mandatory product certification marks, instruction labels, machine serial numbers, etc., appearance marks that are difficult to restore to their original status, or activation, authorization information , unreasonable personal use data retention and other data usage traces;
(3) Garments, shoes and hats, bags, toys, home textiles and household products: trademarks have been picked, logos have been cut, and products have been contaminated and damaged.


Fourth, the return process


Consumers who choose to return without reason should send a return notification to the seller of online goods within seven days from the date of receipt of the goods. Beginning on the 7th day from the day after the receipt of the goods by the consumer.


After receiving the return notification, the online commodity seller should promptly provide consumers with valid and accurate return address, return contact person, return contact phone number, and other valid contact information.
After the consumer obtains the above information, he should promptly return the merchandise and retain the return certificate. (Express orders or waybill numbers must be kept)


When returning goods, consumers should return the goods themselves, accessories and gifts.


Gifts include gifts in kind, points, vouchers, coupons and other forms. If the gifts cannot be returned together, the operator may request the consumer to pay the price of the gifts according to the price of the premiums indicated in advance.


If the goods returned by consumers are intact, the seller of online goods shall return the paid price of the goods to the consumer within seven days from the date of receipt of the returned goods.


Five, on the refund



The refund method is similar to the payment method of buying goods. Where there is otherwise an agreement between the operator and the consumer, the agreement shall prevail.

When purchasing goods in multiple ways to pay the price, they should generally be refunded according to the actual payment of the various payment methods.

Except with the express consent of the consumer, online sellers should not specify their own refund method.

When consumers use the form of points, vouchers, coupons, etc. to pay the price, the seller of online goods should return the consumer in the appropriate form after the consumer returns the goods. The use of credits, vouchers, coupons, and repayments may be agreed upon.

When a consumer uses a credit card payment method and pays a fee for the purchase of goods, the seller of online goods may not refund the fee when he returns the goods.

When a consumer uses a credit card payment method to purchase a commodity and is exempted from the fee by the seller of the online product, the seller of the online commodity may deduct the handling fee at the time of refund.

The return price is based on the price actually paid by the consumer.

If a package or a part of the merchandise in the discounted promotions is returned, resulting in no longer being able to enjoy the discounts, settlement will be made based on the price of each merchandise at the time of purchase.



Sixth, freight commitment


The freight returned by the return of goods shall be borne by the consumers according to law. Where there is an agreement between the operator and the consumer, the agreement shall be followed.

Consumers participate in free shipping activities that meet certain conditions, but after the return has been unable to meet the requirements of free shipping activities, sellers of online goods may deduct shipping charges upon refund.


The seller of online goods can agree on a return method with consumers, but it should not limit the way consumers return goods.

Internet product sellers can pick up the goods for free, or they can obtain the consent of the consumer to collect the goods after payment.
